1. Acceptance of These Terms
These terms of service form a binding agreement between you and JYB WATER SOLUTIONS LLC governing your use of the website located at jybwater.buzz. By accessing any page of this website, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree with all of these terms, you must not use the website or submit any information through it.
These terms also apply to your use of the resources, descriptions, and contact channels that we provide on the website. They do not replace any separate and more detailed agreement that may govern an actual engineering or installation project between us. When you engage us for a specific service, the written agreement for that work will control the project scope, schedule, and payment.
2. The Provider of These Services
This website is provided by JYB WATER SOLUTIONS LLC, a company established under the laws of the United States with its principal offices at 898 S State St Ste 310, Orem, 84097-7045, United States. The water treatment engineering and integrated systems services described here are developed and operated by the developer JYB Water.
References on this website to JYB Water, JYB WATER SOLUTIONS LLC, or the company mean the same legal entity operating from the address above. Any notice under these terms should be sent to the correspondence details listed at the end of this document, including our email address serve@jybwater.buzz and our telephone number +15179961685.
3. Permitted Use of the Website
We grant you a limited, personal, non-exclusive, and non-transferable right to access and view this website for lawful purposes related to understanding our services and contacting us about them. This right does not give you ownership of the website or of any content on it.
You may not use the website for any unlawful purpose, to interfere with the security or operation of the site, to attempt to gain unauthorized access to any part of our systems, or to place an unreasonable load on our servers. You may not use automated means to collect content at scale, to scrape our pages, or to probe our websites for vulnerabilities without our prior written permission.
We may modify, suspend, or discontinue any feature of the website at any time and without prior notice, and we may restrict access to the website or any part of it where we reasonably believe such action is necessary to protect the website or its users.
4. Ownership of Website Content
The text, graphics, images, colors, layout, and organization of this website are the property of JYB WATER SOLUTIONS LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. The visual theme and wording of the site are original and are intended to describe our own engineering services.
Nothing on this website grants you a license to use its content for any commercial purpose, to copy our design, to reproduce our marketing material, or to misrepresent your own offerings as ours. You may share a link to our site and may quote short excerpts for the limited purpose of review, provided you identify the source clearly and do not suggest that we endorse any third party product or service.
Any unauthorized use of our content may violate copyright law and may result in legal action. If you wish to use our material beyond the limited permission above, please request written consent from us before doing so.
5. Accuracy of Website Information
We work to keep the information on this website accurate and current, but no engineering decision should be based solely on a general description that we publish online. Water quality, flow requirements, and treatment performance vary with each site, and real results are determined by the conditions of a particular project.
The performance figures and capabilities we describe on our pages are general indicators of the kinds of systems we design and support. They are not promises that a specific outcome will occur at your facility. Actual performance depends on your source water, operating conditions, maintenance discipline, and many other factors that we can only evaluate once we review your specific situation.
We may update the website from time to time without notice and we reserve the right to correct typographical, descriptive, or technical errors that may appear. You should confirm any detail that matters to your decision with our team before you rely on it.
6. Communications and Inquiries
Our website offers ways to communicate with us, including a contact form and our published telephone and email contacts. When you contact us through any of these channels, you agree to provide information that is accurate, current, and not misleading. You agree that we may use the details you provide to respond to your inquiry.
Messages you send about water systems may describe sensitive technical details about your facility. By submitting such information you authorize us to use it to evaluate your needs and to respond. We will treat the technical content you share as confidential to the extent described in our privacy policy, and we will not disclose it to competitors without your consent.
Because of the volume of inquiries we receive, we cannot guarantee a response to every message within a specific time. However, we make reasonable efforts to reply to legitimate inquiries promptly. Routine technical matters should be directed through our normal channels rather than treated as one of the emergency contacts we may publish for current clients.
7. Proposals, Quotes, and Orders
When you ask us to quote a project, we will provide a proposal that describes the recommended scope, equipment, and approach. A written proposal does not become a binding contract until both parties sign it or until we otherwise agree in writing to proceed on specific terms. Nothing you read on this website, by itself, constitutes an offer to contract.
Project prices and timelines that we share in conversation are estimates to guide your planning. Binding prices, schedules, and deliverables are confirmed only in a signed proposal or contract for a defined scope of work. We may revise an estimate if the conditions at your site differ materially from what you described when you requested the quote.
We reserve the right to decline any project for reasons including, but not limited to, safety concerns, inability to meet your schedule, or conflict with our existing commitments. If we decline, we will return any deposit in accordance with the terms of the relevant proposal.
8. Prices, Payments, and Taxes
Prices for engineering, equipment, commissioning, and service are stated in the relevant proposal or contract and are quoted in United States dollars unless we agree otherwise in writing. Any applicable taxes, permits, or third party fees are additional unless we state that they are included.
Payment terms are set out in each proposal or contract. In general, we may require a deposit before ordering long-lead equipment and progress payments as defined milestones are met. We may also invoice for approved changes in scope separately. Failure to make payments when due may pause work and may be treated as a breach under the relevant contract.
If a project is cancelled after we have ordered equipment or performed design work, you may be responsible for the non-refundable costs we have already incurred, as described in the proposal. We apply any such charges fairly and will explain them before you commit to a cancellation.
9. Site Work and Access
Many of our services require work at a customer facility. When we perform work on site, the customer agrees to provide safe and reasonable access to the equipment and to the water supply, power, and drainage needed to perform the agreed tasks. The customer remains responsible for site safety and for maintaining safe conditions around their equipment.
We will take reasonable care to protect your facility and to work within any safety rules you require us to follow. However, the customer carries the risk of pre-existing conditions in the water distribution, building structure, or power supply that are not of our making, and the customer should disclose any known hazards before we begin.
Where work requires utilities, permits, or third party inspections, those costs and responsibilities are identified in the proposal. We will coordinate with your team where cooperation is needed, but delays caused by site conditions outside our control may adjust the schedule.
10. Our Limited Warranties
We stand behind the engineering and workmanship we provide. To the extent set out in a signed contract, we warrant that the equipment and systems we supply will be free from defects in material and workmanship under normal use and maintenance for the warranty period stated in that contract. Our service work is warranted to be free from defects in workmanship for a reasonable period after completion.
These warranties cover repair or replacement of defective equipment and the correction of defective work, at our option, during the applicable period. They do not cover damage caused by misuse, alteration, neglect, improper operation, power surges, acts of nature, or unauthorized third party repair. Routine consumables such as filters, membranes, lamps, and seals are also outside these warranties unless a contract says otherwise.
To make a warranty claim, contact us with your contract reference and a description of the issue. We will arrange for inspection and correction. These warranties give you specific legal rights, and you may also have other rights that vary from one jurisdiction to another.
11. Disclaimers of Liability
To the maximum extent permitted by law, our warranties and liability described in these terms replace all other warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error free, or entirely free of harmful code.
We are not liable for losses caused by conditions beyond our reasonable control, including natural disasters, supply shortages, power failures, labor disputes, changes in law, or events affecting utility service at a customer site. We are also not liable for the consequences of information that you provide to us being incomplete or inaccurate when we rely on it to design or quote a system.
Because every water system depends on the quality of source water and on disciplined maintenance, we cannot guarantee that any particular water result will be achieved at your site. Where a contract promises a specific performance level, that level is addressed by the limited warranty in that contract and not by any general statement on this website.
12. Limitation of Liability Amounts
To the fullest extent permitted by applicable law, our total liability arising out of or related to your use of this website, or to any service we provide, shall not exceed the amount you actually paid to us under the contract giving rise to the claim during the twelve months before the claim arose, or one thousand United States dollars, whichever is greater.
In no event will we be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, even if we were advised of the possibility of such damages. Statutes in some jurisdictions do not permit the exclusion or limitation of certain liability, so some of the limitations in this section may not apply to you.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation. To the extent permitted, however, the limitations above represent our agreed allocation of risk with you.
13. Your Agreement to Indemnify Us
You agree to indemnify, defend, and hold harmless JYB WATER SOLUTIONS LLC and its officers, employees, agents, and contractors from and against any claims, damages, losses, and expenses arising out of your breach of these terms, your misuse of the website, or your violation of any law or of the rights of a third party.
This indemnity also covers claims arising from information that you provide to us if that information is inaccurate, misleading, or submitted without proper authority. We will notify you promptly of any claim within our control and will cooperate reasonably in your defense of it.
This section survives the termination or expiration of these terms and remains effective for as long as any claim or potential claim covered by it could still be brought.
14. Third Party Links and Content
Our website may include links to third party websites, resources, or tools that we believe may be useful to you, for example a provider we use to deliver secure email forms. These links are provided for your convenience and do not indicate that we endorse the linked site or its operator.
We do not control third party websites and we are not responsible for their content, privacy practices, availability, or accuracy. When you leave our site and visit a third party page, the terms and policies of that third party apply to your use of its services.
We are not responsible for damage or loss you may suffer because of any transaction you conduct with a third party you reach through a link on our site. Review the terms and policies of any third party website before you share personal information or make any commitment there.
15. Service Interruption and Availability
We aim to keep the website available, but we do not guarantee uninterrupted or error free access. The site may be temporarily unavailable for maintenance, for emergency repairs, because of equipment or network failure, or for reasons beyond our control.
You accept that regular maintenance of our systems and occasional outages are part of operating a website, and you should not rely on the site as your only channel for reaching us. Our current telephone and email contacts remain available throughout most such periods, and we will use reasonable efforts to restore access quickly when an interruption is within our control.
16. Acceptable Conduct Online
You agree not to use the website to transmit unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material, or to impersonate any person or entity, or to misrepresent your affiliation with us.
You agree not to attempt to gain unauthorized access to our servers, databases, or accounts, not to probe or test the security of our infrastructure, not to transmit viruses or malicious code, and not to interfere with the proper functioning of the website for other users.
We may monitor activity on the website to maintain security and reliability, and we may remove or restrict access to content or accounts that we reasonably believe violate these terms. We will cooperate with lawful requests from authorities in connection with any violation.
17. Termination and Suspension
We may terminate or suspend your access to the website, in whole or in part, at any time and for any lawful reason, including a breach of these terms, without liability and without prior notice. Upon termination, your right to use the website ends immediately.
These terms remain in force even after your access ends for any provisions that are meant to survive. In particular, the sections on ownership, warranties, disclaimers, limitation of liability, indemnity, and governing law will continue to apply after your use of the website has ended.
Nothing in this section affects our rights under any separate contract with you for engineering, equipment, or service. Termination of access to the website does not terminate a project contract unless that contract says otherwise.
18. Governing Law and Venue
These terms and your use of the website are governed by the laws of the State of Utah and the federal laws of the United States, without regard to their conflict of law provisions. This choice of law applies to all matters relating to these terms, unless a mandatory provision of consumer protection law in your jurisdiction requires otherwise.
Any dispute arising out of or relating to these terms or to your use of the website shall be resolved exclusively in the state or federal courts located in Utah, and you consent to the personal jurisdiction of those courts. If you bring a claim against us in a forum other than this one, we may require that the claim be dismissed and refiled in the agreed venue.
You agree that any claim you raise against us must be filed within one year after the cause of action arises, even where a longer period is otherwise available, to the extent the law permits the parties to impose such a limit. This limitation does not apply to claims that cannot lawfully be so limited.
19. Changes to These Terms
We may revise these terms of service from time to time to reflect changes in our services, in technology, or in legal requirements. When we make a material change, we will update the effective date shown at the top of this page and post a notice on our website so you are aware of the update.
Your continued use of the website after an update is in effect means that you accept the revised terms. If you do not agree with a revision, you should stop using the website. Where the law requires a higher standard of consent for a particular change, we will follow that law before the change applies to you.
20. Severability and Entire Agreement
If any provision of these terms is found to be unlawful, void, or for any reason unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These terms, together with the privacy policy that accompanies them, constitute the entire agreement between you and JYB WATER SOLUTIONS LLC regarding your use of the website and supersede all prior statements, agreements, or understandings about the subject matter. Any waiver of a breach must be in writing and signed by the party against whom it is enforced, and a failure to enforce a right will not waive that right in the future.
